Service Terms / Customer Terms

These customer terms cover B2B account access, configured assessments, respondent data, AI-assisted intake, billing, suspension, and termination.

Contracting party

These Service Terms are between you and Pre-Assessment.com, a Delaware company offering the service to business customers only. Principal business address: 600 California Street, 11th Floor, San Francisco, CA 94108, United States. Contact: [email protected].

Agreement and service description

These Service Terms govern customer and authorized-user access to Pre-Assessment.com, including the hosted application, guided pre-assessment quizzes, adaptive AI-generated questions, structured lead extraction, campaign configuration, respondent sessions, verification features, integrations, support, and related documentation.

An order form, quote, subscription checkout, or other written agreement may set plan limits, fees, subscription periods, usage allowances, and additional commercial terms. If there is a conflict, the signed order form controls for that order.

B2B use and authorized users

The service is intended for business customers, campaign owners, and their authorized personnel. Customer administrators must be at least 18 years old and may access the service only for business purposes or for approved campaigns they operate.

Customers are responsible for all activity under their accounts, for keeping magic links and login codes secure, and for ensuring authorized users comply with these Service Terms.

Customer content, campaigns, and respondent data

Customers may configure campaigns, intake questions, qualification criteria, messages, branding, handoff fields, and related content. Respondents may submit quiz answers, contact details, phone numbers, email addresses, verification status, uploaded documents if enabled, and other information requested by the customer campaign.

As between the parties, customer content and respondent data belong to the customer. Pre-Assessment.com may process that data to provide, secure, support, maintain, and improve the configured service, including generating adaptive questions, extracting structured lead data, resuming sessions, sending return links, and delivering qualified or complete leads to campaign owners.

Customers are responsible for their campaign content, instructions, qualification logic, notices, legal bases, consents, privacy disclosures, use of respondent data, and compliance with laws that apply to their industries and respondents.

AI-assisted features

Pre-Assessment.com may use AI model providers to generate or adapt quiz questions, summarize conversations, classify responses, and extract structured lead information. AI outputs may be inaccurate, incomplete, or unsuitable for a particular use case and should be reviewed with appropriate human oversight before consequential decisions are made.

AI subprocessors are not permitted to use submitted customer or respondent data to train their general models. Customers must not represent AI-generated content as solely human-generated where doing so would be misleading.

  • Customers remain responsible for decisions made using lead scores, summaries, recommendations, or extracted fields.
  • Customers must implement appropriate safeguards for regulated, high-impact, or sensitive use cases.
  • Pre-Assessment.com is not a substitute for legal, financial, medical, credit, employment, or other professional advice.

Sensitive data and prohibited campaigns

Unless expressly enabled in a separate written agreement, customers may not use the service to intentionally collect highly sensitive or special-category data, including health records, biometric identifiers, precise financial account credentials, government identity documents, criminal-offense data, children’s data, or data requiring heightened regulatory safeguards.

The Acceptable Use Policy contains additional prohibited content and abuse rules.

Third-party services and integrations

The service may rely on third-party subprocessors for cloud hosting, database and file storage, email delivery, SMS/phone verification, AI processing, security and abuse prevention, logging and monitoring, customer support, payment processing, and analytics. Customers may also connect their own third-party systems or export data to tools they control.

Pre-Assessment.com is responsible for subprocessors it engages to provide the service. Customers are responsible for third-party services they choose to connect, instructions they give to those services, and data they export from Pre-Assessment.com.

Fees, billing, and taxes

For paid plans, customers must pay the fees described in the applicable order form or checkout flow. Unless otherwise stated in a signed order form or required by law, fees are non-refundable, non-cancellable for the current subscription period, and exclusive of taxes.

Subscription plans may renew automatically if the applicable order form or checkout flow says so. Customers are responsible for timely cancellation before renewal.

Security, availability, and retention

We use reasonable administrative, technical, and organizational measures designed to protect the service and customer data. We do not claim SOC 2, ISO 27001, specific encryption guarantees, or fixed breach-notification windows unless expressly stated in a separate written agreement.

We retain customer account and service data while the account is active and delete or anonymize it within a commercially reasonable period after termination or deletion unless legal, security, backup, dispute, or compliance needs require longer retention.

Suspension and termination

We may suspend or limit access to the service if we believe a customer has breached these terms, created security or legal risk, exceeded usage limits, failed to pay undisputed amounts, or used the service for spam, phishing, fraud, abuse, or unlawful purposes.

Either party may terminate according to the applicable order form or written agreement. Termination may result in loss of access to the service and deletion of data after any export or transition period stated in the order form.

Disclaimers, liability, and indemnity

Except as expressly stated in a signed agreement, the service is provided as-is and as-available, without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, or error-free results.

To the fullest extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Customer will defend and indemnify Pre-Assessment.com against claims arising from customer campaigns, customer content, respondent notices or consents, unlawful use of respondent data, or breach of these terms.

Governing law and updates

Unless an order form says otherwise, these Service Terms are governed by Delaware law, and disputes will be resolved in courts located in Delaware. Jury trial and class action procedures are waived to the extent permitted by law.

We may update these Service Terms from time to time. Material changes will be communicated by reasonable means, such as posting an updated version or notifying account administrators.
